What you need to know
Spain updated Article 34 of the Spanish Workers’ Statute in 2019, shortly after a ruling of the European Court of Justice, making recording working hours essential for employers.
Article 34 requires employers to use a digital register and to keep daily records of all working hours. All data must be kept for four years, and accessibility ensured to employees, legal representatives, and labour and social security inspectors.
With a Royal Decree, of which the details have yet to be decided upon, new changes are expected. These could include clearer definitions of working time, requiring electronic systems with identity verification and traceability, and strict rules on modifications and overtime classification. An important goal is the right to disconnect, ensuring staff are not contacted outside their recorded hours.
